Terms of Service

These Terms of Service (“Terms”) govern your use of https://www.baseassurance.com (the “Site”) and any Home Watch and related services provided by BASE Assurance (“BASE Assurance,” “we,” “us,” or “our”). By using the Site, contacting us, booking services, or receiving services, you agree to these Terms.
Florida only: Our services are offered in Florida. Additional terms may apply to specific services or written service agreements. If there is a conflict, your written service agreement will control.
Bonded & insured: BASE Assurance is insured and bonded. Proof of coverage is available upon request.
1) Home Watch is observational
Home Watch is a visual observation service. We are not a home inspection company, alarm/monitoring provider, security company, insurer, public adjuster, engineer, or remediation company. We do not guarantee that all issues, hazards, or conditions will be discovered, prevented, or avoided.
2) Client responsibilities
- You are responsible for maintaining insurance coverage, utilities, and any required property protections (e.g., HVAC, pest control, pool service) unless otherwise agreed in writing.
- You are responsible for providing accurate property information, emergency contacts, and clear instructions.
- You must provide and maintain safe access (keys/lockbox codes, gate codes, alarm instructions) and notify us promptly of changes.
3) Scheduling, access, and authorization
Visit cadence and scheduling are based on your plan and preferences. Unless otherwise agreed, visit times may vary. By enrolling in services, you authorize us to access the property as needed to perform services according to your instructions and any agreed checklist.
If we identify an issue, we will notify you per your preferences. Any follow-up action beyond the standard visit (including add-ons, vendor access/oversight, or minor services) requires your authorization unless immediate action is reasonably necessary to help prevent significant damage or safety risk and we cannot reach you. In such situations, we will act in good faith and document what we did.
4) Reports and communications (including mobile messaging)
Reports and service communications may be delivered through email, a portal, mobile messaging (including SMS/MMS and similar carrier-based messaging services), phone, in person/verbal communication, or another mutually agreed method.
If you choose (or agree) to receive mobile messages, you consent to receive service-related messages such as scheduling updates, visit notifications, and issue alerts. Message and data rates may apply; message frequency may vary. You may opt out by replying STOP (where supported) or by contacting us. If you opt out, we will use another mutually agreed method.
5) Fees, payments, and refunds
Pricing and plan details are provided on our Site and/or in your service agreement. Online payments are processed by third-party payment processors. We do not store full payment card numbers on our systems.
Cash/check/e-check pricing may reflect a discount; other payment methods may be higher due to processing fees. Unless required by law or stated in a written agreement, fees are non-refundable once services have been scheduled or performed.
6) Add-ons and minor services
Add-ons and minor services (including routine replacements, minor repairs, and coordination) are quoted per request and performed with authorization. Parts billed in addition, unless supplied by customer. We may decline requests that are unsafe, outside scope, or would require specialized licensing, permitting, or expertise.
7) Vendor coordination
If you request vendor access/oversight, we may coordinate access and document observations. We are not responsible for third-party vendor performance, workmanship, timelines, or warranties. Any contracts for third-party services are between you and the vendor.
8) Disclaimers
To the maximum extent permitted by law, the Site and Services are provided “as is” and “as available.” We make no warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Information on the Site is for general informational purposes and does not constitute legal, insurance, or professional advice. You should consult your insurer and/or appropriate professionals regarding policy requirements and property conditions.
9) Limitation of liability
To the maximum extent permitted by law, BASE Assurance will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or use, even if advised of the possibility of such damages.
To the maximum extent permitted by law, our total liability for any claim related to the Services or Site will not exceed (a) for on-demand visits or one-time add-ons, the fees paid for the specific visit/add-on giving rise to the claim, or (b) for recurring plans, the pro-rated equivalent of two (2) months of plan fees.
10) Indemnification
You agree to indemnify and hold harmless BASE Assurance from claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, your instructions, your breach of these Terms, or your violation of applicable law, except to the extent caused by our gross negligence or willful misconduct.
11) Site use and intellectual property
The Site and its content (including text, images, branding, and design) are owned by BASE Assurance or its licensors and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from Site content without our written permission.
You agree not to attempt to interfere with the Site’s operation, access areas you are not authorized to access, or use automated means to scrape or collect content from the Site.
12) Privacy
Our Privacy Policy explains how we collect and use information. By using the Site or Services, you agree to our Privacy Policy.
13) Changes to these Terms
We may update these Terms from time to time. We will post the updated version on this page and update the Effective Date. Your continued use of the Site or Services after changes become effective means you accept the updated Terms.
14) Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Services will be brought in the state or federal courts located in Florida, unless otherwise required by law.
